Employment LAW AND litigation in new york
Federal, state and local laws prohibit discrimination on the basis of race, gender, age, national origin, disability, and other enumerated protected classes. If you believe that a decision regarding your employment - whether you are hired or not hired, fired, passed over for promotion or demoted, or moved to a different position - for a discriminatory reason then I can help you fight this decision.
We can discuss, first of all, whether you have a viable claim. Not every hiring or firing or decision by your boss is subject to being reviewed by a Court. If you do have a claim we will explore your options. A first option might be filing a claim with the U.S. Equal Employment Opportunity Commission or the equivalent New York state or city agencies. This can be the most efficient (and sometimes required) starting point because the government agency will investigate your complaint, may help you reach a settlement or issue you the right to file suit in Court if the case cannot be resolved. The next option might be to sue and if you choose to sue then I can provide representation in pursuing your claims in Court. If I am your attorney I will guide you through the process, explain to you step by step what will happen and always be guided by your best interests. I will be with you from start to finish, from filing the complaint through to trial and, if warranted, appeal. Often it is fruitful to discuss settlement and this can be fostered by mediation. I have been involved in numerous mediations that have resulted in very favorable settlements. However, whether to accept a settlement is always your decision. I have also had numerous cases involving employment contracts, particularly regarding non-compete agreements and trade secret claims. I have conducted evidentiary hearings on injunctions and have been very successful in this practice. These are often fast-moving cases involving complicated legal issues and despite being a solo practitioner I have gotten good results against large law firms. Most recently I have been representing small businesses in claims by employees for unpaid wages and other related causes of action based on Federal and State wage and labor laws. I have had success in defending these actions, including getting several cases dismissed and reaching favorable settlements while avoiding costly litigation. My wide range of experience in employment law allows me to address many different types of potential claims and respond to most questions you may have so I invite you to contact me to discuss your employment issues. |
